Johnson's real estate business could pose problem

While touting himself as a real estate broker devoted solely to helping buyers find what they were looking for, Republican mayoral candidate Ken Johnson was also running another firm that catered to sellers, a move contrary to the ethical standards of a national association to which Johnson belonged for years.
Johnson’s best-known real estate company, A Buyer’s Market, made its money representing buyers searching for a new home or investment property.
To bolster business and develop professional ties, Johnson belonged to the Virginia-based National Association of Exclusive Buyer’s Agents, which calls itself “an independent alliance of real estate professionals who provide client-level services and whose real estate companies do not accept seller-property listings.”
A key element of its ethical standards, stated frequently on its website and literature, is that buyers who turn to “exclusive buyer agents” are looking for brokers who will work only for their interests and do not sell property as well.
Johnson, however, sold many pieces of property through another of his businesses, Properties Plus, for at least the past couple of years.
He quit the national broker’s group only this week, apparently after learning that it was investigating whether he had violated its ethical standards.
Johnson said he resigned “because I’m no longer an exclusive buyer’s agent.”
He said a “fundamental change in the marketplace” has occurred, shifting the power from sellers to buyers because of the glut of property on the market, so he’s aiming now at helping people sell their homes for a set fee.
A Buyer’s Market, he said, is today a firm “dedicated to buyer’s service but it’s not exclusive” any longer because he’s selling property as well.
Johnson said that he had been a member of the national group for years but he never realized that his Properties Plus firm posed a conflict with the rules governing exclusive buyer’s agents.
When it was brought to his attention, he said, he resigned.
Andrew Snow, a broker who serves as the chairman of the national group’s Ethics and Professional Standards Committee, said in an email Thursday that he could not discuss any cases that might have been raised because they are “by their very nature confidential, just the same as many other professional associations.”
Johnson submitted his resignation to Snow in an Oct. 30 email obtained by the Press from a real estate professional unhappy with Johnson’s conduct. The broker asked to remain anonymous because the facts spoke for themselves and disclosure could harm his business and personal relationships.
In the resignation email, Johnson indicates that a problem had been brought to his attention by Snow.
After apologizing “for my delayed reply,” which he attributed to being “entirely focused” on “running for political office,” Johnson wrote, “The most expeditious action for me is to simply drop my NAEBA membership.”
Johnson said he did nothing wrong and as soon as he realized that he did not qualify for membership in the national group, he left its ranks.
However, there are scores of “exclusive buyer’s agents” advertising their businesses on the internet in many states and all of them tout their refusal to represent sellers.
“Exclusive Buyer's Agents never take listings and never represent Sellers!” says The Buyers Agent of NW Florida in Pensacola. “They always represent Buyers and never try to work for work for the buyer and seller at the same time.”
The central concept is that exclusive buyer’s agents can’t ever face the dilemma, even remotely, of representing a buyer and a seller at the same time, a happenstance which could make them less likely to look out only for buyers.
Johnson said that his Democratic opponent, Art Ward, may have had a hand in trying to turn the real estate issue into a campaign tool to lever votes on Tuesday.
Johnson said Ward has dodged answering questions about his role in the state Freedom of Information complaint that resident Jay Meisinger filed against the city “while at the same time conjuring stuff up to try to smear me in the final days before the election.”
Johnson said it is time for “an end to this bitter divisiveness” that would lead candidates in Bristol to seek “personal and political benefit” by creating issues out of nothing.
However, this matter was not raised by Ward or anyone connected to his campaign. Instead, it was brought to the Press’s attention by a real estate professional with no obvious Bristol ties who thought voters should weigh it when considering Johnson’s integrity.

Let's sart digging on Ward! He and Couture are lieing about the Mall deal. Ward was present as were many politicians. The FOI complaint came from Ward no matter what he says.

This is ridiculous and is more reason why we need new blood. Too bad Ellen refused to understand the impressions she gave off as aloof and condescending.

Steve, you posted this story, and have refused to post any details about Ward's DUI incident, including the sleazy way he tried to get the charges dropped. I know you said that would require extra effort on your part, but since you saw fit to report this development with Johnson, you have an obligation to be fair to the opponent, whether it was Zoppo or now especially Johnson, since the story posted just today is intended to suggest to people that Johnson was unethical. The same could be said about Ward, except he was an elected official at the time of his incident.

The complaint was filed by a guy named John Hermann of Farmington. He runs a buyers representative agency in Farmington.

Mr. Hermann was upset that Ken got leads and he didn't.

Ken has the business sense to understand that when the market is down and no one is buying homes that you have to diversify and start selling homes.

These is the business sense I want in the Mayor's Chair. Someone who will think outside the box.

I'm not sure why Ken is claiming that due to a market change he just began taking seller listings. He was listing homes nearly 2 years ago, starting on 12/23/05. Since then, he has taken 47 seller listings worth just over 13 million dollars. I find it hard to believe Ken only worked in the best interest of buyers in the past two years. I'm sure he told the buyers he was only looking out for their best interests because he didnt waste his resources marketing listings. I wonder if he plans on using the same business practice if he gets elected.

Ward's DUI occurred in 1997 and was reported, thoroughly, in a story bannered across the top of the Press. It's old news now. But I believe I said that if someone wanted to look up the story and type it up, I would post it here. Nobody took me up on that.
This story concerns Johnson's resignation from a real estate group THIS WEEK after questions were raised about whether he was following its ethical rules. That's certainly relevant and newsworthy.
Should it matter to voters? I have no idea. That's not up to me.

The man is a war hero and patriot and has served Bristol honorably. He's worked very hard for the citizens in his district and all of Bristol. Instead of pointing fingers all over the place, point at the person who did the deed - Mr. Johnson himself. We actually should thank whoever stepped forward...if Ken had somehow actually gotten himself elected and the story came out after, Bristol would have been the next "Waterbury."

Seeing as how Ken was told by the Bristol Press that the real estate association resignation issue was divulged by one of his own collegues, I think that Ken owes an apology to the ward campaign for insinuating that they contributed sinister activity on this matter - shame on him.

Actually, I did not get permission to identify the source of the information in any way at all until AFTER I spoke with Ken Johnson. The source agreed that failing to let me describe them in at least a vague way would perhaps leave some people with the impression that Ward or his campaign told me.

What Johnson did may have been unethical according to association membership guidelines, but it was not illegal in Connecticut.

Is DUI still illegal in Connecticut? Is it ethical for an elected official to try bullying the police officer and trying to escape punishment through legal loopholes that blame the police for doing their job?

Thats all great, but why and how did you get the info word for word from Kens resignation? What a bunch of evil people out there! How sad! Obviously Ken was not keeping his Properties Plus business a secret or he would not have been advertising. I am surprised that you of all people would do something like this. I really am at a loss for words that after 2 years of this business being established that 4 days FOUR before the election this comes out of NOWHERE! Dont you find that peculiar! Another vendeta, another personal attack against someone that wants to do good for our crookedly run city! Where is the dirt on WARD I cant see that he is some do gooder that has ZERO skeletons. Are you partial to the Ward camp too? Something is just plain rotten here. Mr. Johnson is a good man with a great upbringing, I find it hard to believe that you all are so eager to have a drunk run our city that you would shoot the best candidate we have in the A**. Too bad! If I had the money I would move away from here so fast, this is not a good enviroment for my children, its an absolute disgrace that Bristol CT is no longer a place I wish to call home!!! I would blog how strong the ties are but it would hurt the other family.

Difference is that while Ward did get arrested, I do not believe that he has been stopped since.
On the other hand, Johnson seems to have a string of occurences that are of a questionable behaviour: credibility, ethics, etc.
Keep in mind that HE brought up city contracts: that sure makes it fair game.

How many other instances are there?

I looked at the MLS listings. What Johnson did is wrong. He called himself an exclusive buyer's agent while listing millions and millions of dollars worth of property. It's totally unethical.

Ken is allowed by law to represent both both the seller and buyer of a particular property but he both parties must be made aware that the agent/broker reprsents both partiers....this is called dual/desegnated agency agreement and all parties involved in the transaction MUST sign in order to agree to accept dual agency. Realtors take an oath. Part of that oath is to report unethical behavior of other agents to appropriate parties. I would suspect that the organization that Ken belonged to, Asssociation of Exclusive Buyers Agents, has a similiar clause. Ken was in the wrong period. Would I have reported this to the press? Probably not. Ken did not break any laws unless of course he failed to have both parties sign that they agree to dual agency but his actions speak to his ethics or lack there of.

For the 7:37 poster, I know you're probally a genius, moreso that the rest of Bristol but just so that you know,

Ken Johnson owns two realestate companies. One is A Buyers Market where he deals with the Buyers only and the other is Properties Plus. He charges one set fee and lists the house on MLS. He does not charge the traditional 5-6% commission fee.

If you looked at the MLS listings I defy you to find one that says call A Buyers Market.

Again, Ken has the business sense to think outside the box and come up with new and creative ideas.

He owns a real estate business and his job is to sell houses.

JUst becasue Art Ward owned a bar does that mean he is an alcoholic?

CAN'T ONE CAN BE A BUYERS AGENT FOR ONE AND A SELLERS AGENT FOR ANOTHER (not related to the same deal)? There is nothing "unethical" about that.

Actually, we bought a house in West Hartford in 1999. And thank God for that, too, since the way home prices have skyrocketed, we'd have been out of luck had we waited.

Question, does he have any equipment, computers etc. that he is using and hasn't paid taxes to the city on?

TO the 9:34pm poster:

I too looked at MLS and found that Ken had listed several properties under his business name "Properties Plus" but some of those that sold were also sold by Ken and the selling agency was listed as "a Buyers Market LLC".....both of which are owned by Ken. When I sell a home AND find a buyer for the same home I list my company as the listing and selling agency. I'm not sure why Ken would do it his way unless he was trying to hide something or did not get a dual agency agreement signed......NO WAY around it Ken is not as smart as you may think he is. If he was he would not find himself in the position of defending his actions, he would put himself above reproach, reputation is everything.

ou also mentioned that Ken charges on flat fee to sell a home, I bet if you went to city hall and looked at the real estate proposals Ken's proposal would not have been a flat fee, if it were chance are he would ahve been awarded that contract.

I sure wish it was Frank Johnson running for Mayor instead of Ken Johnson. He's smarter than all of the candidates running for office put together. Please consider running next term Frank!!

I'm not going to go any further in ruling out sources, but I must say given what's going on that John Hermann was not the source. I have no idea who he is.
