Organizers of referendum drive have 45 days to gather signatures

Dale Clift, the city attorney, ruled today in this opinion, that those gathering signatures to force a referendum on the chief operating officer proposal have the full 45 days to turn in petitions. That helps give the organizers time to scrape together than 3,100 or so signatures they need.
City Councilor Ken Cockayne, one of those pushing the referendum, said he is "very happy at the thoroughness" and speed with which Clift issued a ruling on the matter. He is also, of course, content with the decision.
Organizers had worried they had to turn in the petitions early enough to have them certified within the 45-day period.

It's 45 days from the June 16 rejection of the COO proposal by the City Council.

So that would be July 31 - then add another 7 days for verification of signatures which would bring us to August 7th. Will this be enough time to put it on the November ballot? I don't know when the deadline for the ballot entrance would be.

Signatures are being collected today, Saturday, June 28th at Forestville Stop and Shop on Pine Street from 11 am to 5 pm.

in the past I seem to remember that the cities need to report ballot questions by early September.

STEVE, is this really necessary to post? I'm not acting stupid nor am I stupid by any means.

There are processes that the petition needs to go through before it is accepted for consideration to the ballot - AND there is a date that it has to be approved by BEFORE it can be placed on the ballot.

ALSO if the City Clerk deems that the petition does not meet the requirements for referendum, there is an appeals process, which also requires I believe 30 days - but I'm not sure.

I'm trying find out what the deadline dates are. There are more dates to be considered here than just the end of the 45 days.

Maybe an article that explains the petition process and how it relates to this particular situation would be worth while.

NOTE TO MINOR, MCCAULEY AND YARDE:

I as well as others have noticed that Craig Yarde is leaving petitions unattended at local businesses. This means that he is not there to verify the authenticity of the person signing the petition.

As you are aware, this is a violation of the terms of the peitition process and is a violation of the oath he will need to take when he turns in his sheets to the City Clerk's office.

From someone that has signed the petition legitimately, it would be a shame if signatures were not counted due to this gross negligence.

Please remove the petitions that Mr. Yarde left behind and re-gain the signatures the appropriate way.

I hope the City Clerk knows to pull all petitions turned in by Craig "I want to run the city" Yarde and verify that he was there to witness each signature.

Just because he's Craig Yarde doesn't mean that he had the right to break the rules of the petition.
