Re: FOI complaint against Mayor William Stortz and City of Bristol
Following information published in The Bristol Press on Tuesday, June 5, 2007, it would appear that 6 members of the 7-member Bristol City Council engaged in one or more unannounced meetings, without proper public notice, electronically or in person, in violation of the Connecticut Freedom of Information Act to discuss and render a decision on the matter of establishing a downtown corporation. Furthermore, it would appear that the final noticed public meeting to vote on January 18, 2007 was not scheduled until the vote had been privately discussed and agreed upon.
It appears from emails distributed through the city’s email system, upon which the reporter based the enclosed news stories, that some Bristol City Council members had polled their collective yea and nay votes outside of the confines of any public meeting, including a continued public hearing of the Ordinance Committee. The parties then clearly worked to prepare scripted responses to voice their support. They clearly agreed to coordinate their responses to a vote that had not been publicly taken, probably via emails and telephone. Some emails of these elected officials may have been made with electronic addresses that are not public and thus not subject to the FOI request made by the reporter, yet may have been the means by which public officials performed the public’s business in a private manner. The Commission is better equipped to request all pertinent information from all parties and all sources. The secret nature of these transactions are clear from the attempt to exclude at least one other elected official, Councilman Art Ward, from all discussion.
Since the charter involves members of both political parties, no one can claim the right to caucus as a political party.
Per information in the newspaper article, those persons primarily involved in the FOI violation appear to be Mayor William Stortz and Councilwoman Ellen Zoppo, City Hall, 111 North Main St., Bristol, CT 06010. Mayor’s office telephone number (860) 584-6250. Others involved include Councilmen Michael Rimcoski, Kevin McCauley and Craig Minor who also may be addressed through city hall.
There seems to be a prima facie case for collective decision making by the Bristol City Council outside of the public meeting process and preparing their collective response outside of public channels. The latter is most clear but it would not have been possible without the former action – collectively voting “yes” in private. The scripts are the fruits of private polling, in effect, a virtual meeting outside the public eye. It is the collective nature and subsequent requests for secrecy that draws attention to these actions.
If section 1-206,4c of the statute applies, then the actions to establish the corporation and all subsequent action by the Council and the new corporation might be null and void based upon inappropriate action by the Bristol City Council.
Although the actions in question may have occurred in December of 2006 and January of 2007, the actions just became known to people by reason of the Bristol Press article on June 5, 2007, therefore the time period to file this complaint is timely as it remains open for 30 days – until July 4, 2007.
There is sufficient reason to request an investigation of the facts by the FOI Commission and to determine if there was a violation of the letter and spirit of the regulations. The enclosed news articles are important to the uncovering of these events but the enclosed emails are largely self-explanatory.
I trust that the Commission will find sufficient cause to investigate and then to draw conclusions. Because these actions that were kept secret for five or more months are now leading to the expenditure of substantial public funds, the commitment of legal resources as well as the commitment of other public resources, the Commission should consider granting interlocutory relief by way of an interim order before further public resources are committed or used.

I have not seen the complaint but have been advised of its receipt at City Hall by the Corporation Counsel's office.
I am aware that it has been submitted by a close friend and political ally of Art Ward's, Jay Meisinger, who is the current Commander of the American Legion.
I do not believe the FOI complaint has any merit and I am disappointed that this has resulted in the city being placed in a position of having to expend resources to defend what was in fact meeting preparation by me, the chair of the Ordinance Committee, as it relates to the ordinance meetings and public hearings on the downtown corporation. I have stated earlier that the word I used, which was script, was an extremely poor word choice and does not reflect that the document used was merely my detailed agenda and order of how the meeting was to be handled. The documents that I shared with you and others clearly indicate that I was tracking concerns of both the public and the members of the council as the public hearings progressed so that nothing would fall through the cracks. There were also variety of technical amendments and a continuance of the public hearing.
I will not apologize for meeting preparation and I do believe that if the City of Bristol has to go forward with defending this claim at the FOI Commission in Hartford, that we will prevail.

He can't get in on his own abilities nor his many years of ineffective presense on the council.
This election year is turning out to be a terrible black eye on the history of Bristol.

Oops, how conveniently she forgot to mention the effort to make sure that rimcoski kept the materials away from ward and that the "scripts" were to be gathered up at the end of the meeting in order to prevent any "leaks" from occurring - must have been some very secretive stuff in there for that concern to have existed.
what else has she "forgotten?" to let the public know and how many yther deceitful practices has she manipulated? Guess that we'll never know but can only guess because ellen won't tell us, that's for sure.
Throughout the entire "scriptgate" fiasco the one word that kept burning in my head was the word "leaks". When you do not want something to leak out, it means that you are trying to cover something up, or hide something, for fear of being discovered. The word or phrase definately has a negative and/or illegal foundation to it. At least Mr. Ward was smart enough to recognize danger and stay out of it. I guess the real question should be "Why didn't this issue go before the ethics board?" This really bothered me. Anyone else?

So Ellen you are disappointed? You got caught playing a game and now you want to cover your tracks! I have known Jay for many years and he filed this on his own it had nothing to do with Ward. I can just see if Ward did this to you - a billboard would have been taken out on Main Street!
As for the comment how is this good for Bristol? It shows Zoppo's true colors and movtives, and how sneaky she can be. It proves to Bristol to be very careful when going to the voting booth!
It was okay when Mr. Minor FOI Mayor Stortz's e-mails, in which they were trying to show that he was not telling the City Council everything about Job Lot.
I can only imagine who orchestrated that one, and I don't think it was Minor or even McCauley.
See how she tries to eliminate the competition. First Councilman Ward and then the Mayor.
Shame on Ms. Zoppo always trying to come in the back door.
My question is if she can do this to the Mayor and a fellow Council Member, what is she going to keep from the public to get what she wants????
Oh, and I forgot to mention: this FOI complaint is completely false. No illegal meeting ever took place. This is selfish, reckless, partisan politics at its worst and it will be revealed for what it really is in due time.
I don't know why Mrs Zoppo-Sassu's running mate would want to throw himself into the limelight and becomes her personal judge and jury. A real smart campaign manager would probably advise him to leave this one alone, at least for the time being. This is a major issue of political significance and may have a far-reaching effect on the local Democratic party, and the fall-out may be overwhelming. Understand that this is a broad, large scale issue with potentially serious reprocutions. Saying "Make sure this doesn't leak out" can't be part of a positive thought process. It actually smacks of political corruption and an ethics violations to me. Last election, there was a big push for our presently established ethics board. Why doesn't anyone use it? Does it have investigative powers or is another one of those do nothing boards? Seems to me like a good forum for this issue. I'm sure the accused would like the opportunity to be exonerated.
Councilman and those who still dare try to justify these actions:
Secret meeting or no secret meeting, scripting or no scripting, Ms Zoppo/Mrs Sassu manipulated our councilmen and Mayor. The end result comes from her own mouth and emails... she "scripted" and destroyed any trust that the city of Bristol should have in her. It's a shame that an honorable police officer has to share a name with her.
As for "dough-heads" and "clowns" disappearing...just don't count on it. We are Bristol Citizens and Taxpayers. Why has no one said it? Mentioned the word? DICTATOR. Whether or not there was commaderie between all council, they each had an elected responsibility to know the law and, more importantly, simple RIGHT from WRONG. Eliminating input from one or more councilmen because "they hardly spoke in 2 yrs," is, quite frankly, juvenile.
And, YES, you have probably noticed that I am upset, angry, bewildered, naive, insulted (no one measures up to her 'intelligence).
I will agree that she spoke the truth when she said (out of the side of her mouth but true), "Karen Pio, president of the GBPOA ...is neutral due to their longevity in the community and the integrity, they have displayed while lobbying City Hall for landlord issues." "They asked had questions and pushed for many changes in the ordinance and I know I respect them..."
We are diligent of our integrity and proud of the respect that we have earned over 11 years working with lobal, state and federal legislators. We study and learn the laws and abide by them. When we feel some may need updating or changing, we do it LEGALLY.
There are no skeletons in our closet. If you want to know something, I tell people, ASK ME. That way, there's just nothing to blackmail me about. GBPOA is the largest and most respected property owners group in CT and hire an upstanding Lobbyist at the Capitol.
In that regard, Ms Zoppo/Mrs Sassu does not hold a candle to our association AND I regret that I allowed her into my home pretending to show concern about the new school site in the West End and trying to push me to push my neighbors which I refused to do.
Ellen wrote an agenda to keep a very long meeting on track. Big deal. If you read any book at all on how to run a successful meeting, the first thing that is mentioned is the importance of writing an agenda. It's a standard business practice that has been around for decades. It is essential to have an outline of everything that is to be covered in a meeting and who is going to speak to each of the topics. Ellen mistakenly called the agenda a "script." It was not a script. A script has exact wording in it for others to read. Ellen's agenda merely listed points for others to talk about.
It is a known fact that Art Ward completely alienated the Mayor and the rest of the City Council (even his own fellow Democrats) for years. He was part of the elected team, but refused to get along with them. His dismissal of the rest of the team was total arrogance on his part. Who could blame the other members of the team for not wanting to share an agenda with him when he barely spoke to them? Art brought the whole thing on himself. Now he retaliates by getting his good friend to sue the rest of his teammates. It's time to take your bat and ball and go home Art. Obviously, you were never willing to step up to the plate for the good of the City.
Unbelievable!! A person comes up with an agenda for the council she is on to forward a plan she is championing? For shame Ellen for showing leadership on an issue and preparing an organised, detailed, "pitch" for your vision of the future of our town. Leave it to the ubstructionists in this town of both parties to be behind this smear campaign. Maybe people like Art Ward should attend more meetings. That might go a long way to being better informed.

I don't have a real smart campaign manager (just me) but I'll go out on a limb and take my chances with the simple truth. As for why would I want to do that, well, my name was slimed in that "complaint" (I hate to dignify it with that word) too. There was no illegal meeting and there was no "pre-determined outcome".

Okay, I'll try to reconstruct it.
I could tell you that it was my own idea to use the FOIA get to the bottom of "what did he know and when did he know it" by asking the Mayor to provide me with all relevant emails between him and the town attorney, which is true, but you seem to think that Ellen is the only one on the city council who knows how to do anything. I'm sure she would be flattered to know that you think so, but I assure you, most of us do have our own ideas once in a while.
Craig, the best part about an FOI complaint is that your opinion means nothing - FOI maintains an impartial position - something which ellen has not informed you how to address,
